Kona Cycle Rental and Tour Terms
These terms and conditions apply to bicycle rentals (hereinafter referred to as “Rental”) and bicycles operated by Kona Cycle (307 Kona, Izunokuni City, Shizuoka Prefecture, hereinafter referred to as “Store”) operated by Kona Resort Co., Ltd. (hereinafter referred to as “Company”). This applies to customers using the tour (hereinafter referred to as the “Tour”). Please note that matters not stipulated in these terms and conditions shall be governed by laws or general customs.
Article 1 (Purpose)
Through the use of this service, the store aims to enrich customers’ travel experiences and contribute to the spread of eBikes and sports bikes in Izu.
Article 2 (Usage qualifications)
Rentals and tours can only be used by customers who meet all of the following items.
- Those who agree with the purpose of the store and are able to abide by these terms and other traffic rules.
Those who have a domestic phone number (including a mobile number) that can be contacted by the store. - Customers residing outside of Japan must have a valid e-mail address in addition to a phone number in their country of residence.
- Must be able to carry an ID on the rental day and present it to store staff. Customers residing outside of Japan must have a passport and a valid credit card as guarantee.
- Those who are in good health to be able to use a sports cycle.Also, those who do not have a chronic disease such as epilepsy.
- (When using an eBike) Must be over 150cm tall. (Except for eBikes, height restrictions are in line with bicycle standards)
- Those who are not under the influence of alcohol.
- Those who are not related to organized crime.
- Those who do not have an infectious disease or any other infectious disease that may be transmitted to others.
- If the user is under 18 years of age, a parent or person over 18 years of age (hereinafter referred to as a “guardian”) can accompany the user during the rental period. , the guardian shall be jointly and severally liable under these Terms.
- Those who have not been delinquent in paying for our services in the past.
- Other than those who have been determined by our company to be unsuitable for using the store.
Article 3 (Reservation)
- Customers can make advance reservations by applying online or by calling the store by 6:00 pm the day before the desired rental date.
- When making a reservation, please provide the user’s name, age, height, phone number, desired rental date and time, and desired optional service.
- If you would like to use any of the optional services, please let us know when making your reservation.
- Depending on inventory status, we may refuse to lend you the item.
- Even if you do not make a reservation, it is possible to rent the item on the same day if it is in stock. However, priority will be given to customers who have made advance reservations.
- If you think you will be late for your reservation on the day of rental, please call the store before your reservation time. If one hour passes after the reservation time without contacting us, the reservation will be treated as a cancellation.
- If the height you registered in your reservation application is different from your actual height, and if you do not fit the recommended height of the rental bicycle, or if the store cannot confirm the bicycle’s safety, we will refuse to lend you the bicycle.
Article 4 (Change of reservation)
Customers can change their reservation dates by contacting the store in advance and receiving approval.
Article 5 (Cancellation of reservation)
- Customers can cancel their reservations by calling the store by the closing time* of the day before the desired rental date. 〈*As of October 1, 2020, it is 6:00 p.m. 〉
- If 1 hour has passed from the reservation time without prior notification, the reservation will be automatically canceled and 100% of the rental fee or tour fee will be charged as a cancellation fee without notification.
- If canceled due to rain or other reasons, 100% of the rental fee or tour fee will be charged. However, if there is an announcement of a warning or higher in the rental/tour target area, or if our staff determines that it is dangerous, we may refuse the tour or rental. In this case only, no cancellation fee will be charged.
- Rental cancellation fees will apply as follows: (Tour cancellation fees are set for each tour.)

Article 6 (Usage application procedure)
The procedure for applying for use is as follows.
- Confirm the rental period, rental and tour contents, rental parts, and options with the store staff.
- Fill in the specified information on the rental and tour application form. You will be required to sign the important confirmation items and disclaimer.
- Hand over the rental and tour application form and ID (driver’s license, passport, or other photo ID) to the store staff. Please note that store staff will check your ID and make a copy. For customers residing outside of Japan, we will verify the validity of your credit card as an additional guarantee.
- We will settle the rental fee. Rental fees shall be as determined separately and, in principle, shall be settled in advance.
- Store staff will provide instructions on how to use the rental bicycles and parts (hereinafter referred to as “rental products”). Store staff will adjust the rental bike to suit the customer.
- The customer and store staff will jointly confirm that the loaned product is free of maintenance defects.
- Store staff will hand over the loaned product to the customer.
Article 7 (Return of rented products)
- Customers must return the borrowed item to the scheduled return location by the scheduled return time.
- Please return the loaned items in the same condition as when you rented them. If there is any abnormality or malfunction, please notify store staff immediately.
Article 8 (Establishment of rental contract)
- The rental contract for rental products is concluded when the store receives the rental fee and hands over the rental product to the customer.
- If the rental product reserved by the customer cannot be rented out due to accident, theft, or other reasons not attributable to the store or each operating company, the store may cancel consent for the customer’s reservation.
Article 9 (Invalidity of application for use)
If the customer falls under any of the following items during the rental period, the store may invalidate the customer’s application without any notice and immediately request the return of the loaned product. . In this case, the rental fee received by the store under Article 6 will not be returned at all.
① When you perform an act that violates these Terms of Use.
② When an accident occurs due to reasons attributable to the customer.
Article 10 (Lending period exceeded)
- If you think it will be past the scheduled return time, please contact the store immediately.
- If the customer returns the item after the rental period has expired, the customer shall pay a separately determined overage fee.
- If the return delay causes damage to a third party, such as the next applicant being unable to use it, the Company shall compensate for the damage.
- If we do not hear from you and the item is not returned after the scheduled return time, we may contact you by phone, mail, email, etc. to confirm. Please note that even if you do not contact us, additional charges will still be incurred in accordance with these Terms.
Article 11 (About checked baggage)
- Customers applying for rentals and tours may store their luggage while using the service.
- For baggage storage and delivery services, please select the service when applying.
- Please do not leave valuables in your checked baggage. The store and operating company will not be held responsible for any damage such as theft.
- Do not put food, living things, hazardous materials, or other items that may cause water leakage or odor. If the store, customer, or third party suffers damage as a result of these, the owner will be responsible for compensation. In the event of a water leak or foul odor, store staff may open your package without your permission and attempt to resolve the issue.
- No use is permitted outside of store business hours.
- Before you leave, please check that your luggage has been received. If there is any baggage left behind after it is returned to the customer, the store will store it for three months from the return date, but if the store cannot contact you or does not come to pick it up during that time, it will be disposed of after the storage period ends. Masu. Disposal costs will be borne by the customer, and no objections will be accepted after disposal.
Article 12 (Bicycle collection)
- If for some reason you are unable to reach the return point while cycling, we will collect your bicycle at the following rate. Customers are responsible for arranging their own means of transportation and transportation costs from the collection point.

2. In case of more than 6 vehicles, an additional amount shall apply for each additional 6 vehicles, corresponding to the respective distance.
Article 13 (Theft/Loss)
- 1. If your item is stolen or lost, please contact the store immediately.
- If the rental product is stolen or lost due to reasons attributable to the customer, the customer will be charged the following amount of damages.

Article 14 (Failure/Damage)
- If a rental bicycle or equipment breaks down or is damaged, please stop operating it immediately and contact the store.
- If the rental bicycle or equipment breaks down or is damaged due to reasons attributable to the customer, the customer will be charged the following repair costs.
- In principle, the cost of puncture repair will be borne by the customer. Please pay close attention to road conditions when driving. We will also provide a puncture repair kit (300 yen) to customers who request it.
- In principle, punctures must be repaired at your own expense. If we repair a puncture or if you fall and damage a part of your bicycle, we will charge the following amount.

Article 15 (Puncture compensation system)
- Rental and tour users may voluntarily join the compensation system provided by our company. If you join this compensation system, we will cover the cost of replacing your bicycle or repairing it at a nearby bicycle shop in case of a flat tire during rental or tour use.

2. If the rental bicycle is damaged due to customer negligence while participating in this system, the repair or replacement cost will be waived up to a maximum of 500,000 yen. However, if the repair or replacement cost of the rental bicycle exceeds 20,000 yen, the customer will be required to pay a 20,000 yen deductible.
3. Please note that this compensation system does not apply to injuries such as injuries. Please purchase accident insurance provided by a separate insurance company.
Article 16 (Accident)
- If you have an accident during the rental period, please contact the store immediately.
- If necessary, please take the measures required by law yourself, such as contacting the police.
- If damage is caused to the store or a third party due to reasons attributable to the customer, the customer shall compensate for this.
- The store and each operating company will not be held responsible for any damage caused to customers or third parties due to bicycle malfunctions caused by an accident.
- If it is necessary to negotiate a settlement regarding an accident, the customer is responsible for doing so. The store and each operating company are not responsible for any accidents.
- If you have insurance, please consult with your insurance company regarding compensation within the scope of coverage covered by your insurance.
Article 17 (Prohibited acts)
- During the rental period, the customer must not allow anyone other than the user who filled out the bicycle rental application form to use the rental product.
- During the rental period, the customer must not engage in the following prohibited acts.
① Reckless driving, driving under the influence of alcohol, and other acts that violate traffic rules.
② Use in dangerous locations, inappropriate locations or methods.
③ Acts that obstruct the passage of pedestrians, etc.
④ Modifications and changes to the structure, equipment, etc. of rental products.
⑤ Riding without a helmet.
⑥ Other acts that violate laws and regulations.
Article 18 (Premature termination due to force majeure)
During the rental period, if the rental product becomes unusable due to a natural disaster or other force majeure event not attributable to the store, each operating company, or the customer, the rental agreement will be terminated. In this case, the customer must promptly notify the store to that effect, and the rental fee will not be refunded.
Article 19 (Good faith rule)
In the event that any doubt arises regarding the contents of these Terms or any matter not stated in these Terms arises, the customer, store, and each operating company shall discuss in good faith and endeavor to resolve the issue.
Article 20 (agreed jurisdiction court)
If a dispute arises regarding the rights and obligations under these Terms, we agree that the exclusive jurisdiction shall be the district court that has jurisdiction over each operating company’s head office or store.
*The contents of the Terms of Use are subject to change without prior notice. The revised terms will become effective from the time they are displayed on the website.
